## 4. Limitation of Liability

### 4.1 Aggregate Cap
In no event shall either party's total aggregate liability arising out of or related to this Agreement exceed the total fees paid by Customer hereunder in the twelve (12) months preceding the initial claim.

### 4.2 Exclusions
The limitations in Section 4.1 shall not apply to:
- (a) Either party's breach of Section 8 (Confidentiality);
- (b) Indemnification obligations under Section 9;
- (c) Gross negligence or willful misconduct.
